1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the SmartViewz platform operated by BotMakers, Inc. ("BotMakers," "we," "us," or "our"). By accessing or using SmartViewz, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

SmartViewz is a SaaS dashboard platform that integrates with Smart Office to provide insurance agencies and individual agents with data visualization, AI-powered analytics, revenue intelligence, agent scoring, and operational automation tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • Individual agents must provide a valid National Producer Number (NPN) that can be verified against synced agency data
  • Agency accounts are established through a guided onboarding process with BotMakers
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account

4. Permitted Use

You may use SmartViewz only for lawful purposes related to your insurance business operations. You agree not to:

  • Access data belonging to other organizations or users outside your authorized scope
  • Attempt to circumvent role-based access controls or data isolation measures
  • Use the Service to store, transmit, or process data in violation of applicable laws
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Resell, sublicense, or redistribute the Service without written authorization

5. Data Ownership

You retain ownership of all insurance data synced from Smart Office to SmartViewz. BotMakers does not claim ownership of your data. We use your data solely to provide and improve the Service as described in our Privacy Policy.

AI-generated insights, reports, and analytics produced by SmartViewz based on your data are provided for informational purposes only and do not constitute professional advice.

6. Smart Office Integration

SmartViewz integrates with Smart Office through an authorized API connection maintained by BotMakers. You acknowledge that:

  • Data accuracy depends on the data in your Smart Office instance
  • Data is synced periodically (approximately every 15 minutes) and may not reflect real-time changes
  • BotMakers is not responsible for data quality issues originating from Smart Office
  • Changes to Smart Office's API may temporarily affect the Service

7. Subscription and Billing

  • Certain features of SmartViewz require a paid subscription
  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' written notice
  • Failure to pay may result in suspension or termination of your account

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTMAKERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to BotMakers in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless BotMakers, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate the account at any time. Upon termination:

  • Your access to the Service will be revoked
  • Your data will be retained for 30 days, after which it will be permanently deleted
  • You may request an export of your data before termination

We reserve the right to terminate accounts that violate these Terms without notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Texas.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
